Privacy Policy
This Privacy Policy explains how Byte Nimble Inc. collects, uses, shares and protects personal information when you use the AI Song Generator website and Studio, and how you can access, export or delete your data. We do not sell your personal information, and we do not use your prompts, lyrics, uploads or tracks to train AI models.
Section 01
1. Who we are
Byte Nimble Inc., [Registered address, set NEXT_PUBLIC_LEGAL_ADDRESS] (we, us or our) provides the AI Song Generator website and Studio (the Service) and is responsible for the personal information described in this policy. Under European data protection law, we are the controller. You can contact us about privacy at [email protected]. If we appoint a representative in the EU or the UK, their details will be listed here.
Section 02
2. Information we collect
We collect information you give us, information created when you use the Service, and a limited amount of information from the companies we work with, such as payment status from our payment provider.
- Account information: email address, display name, sign-in method, password (stored only as a secure hash by our authentication provider), preferences and settings. If you continue with Google, Google shares your name, email address and profile picture with us; we do not receive your Google password or access to your other Google data.
- Billing information: plan, subscription status, billing country, invoices, payment history and the last digits and type of your card. Full card details are collected by Stripe, not by us.
- Your content: prompts, lyrics, style text, titles, uploaded audio, images and video, generated tracks, stems, MIDI, videos, lyric drafts, projects, playlists and publications.
- Voice recordings: if you create a custom singer voice, the recordings and verification recordings you provide, with your consent and authorization records.
- Photos of people: if you upload a photo that shows a person, for example to make a lip-sync video, the photo and the likeness consent you confirm.
- Rights, consent and moderation records: the confirmations you give in the Studio (for example that you own an upload or have someone's consent), with the policy version, time and related IP address; and records of requests or uploads our automated checks refused or flagged, which hold the rule and the matched word, not your full text.
- Usage and device information: generation requests, credit transactions, features used, browser and device type, IP address, approximate location derived from it, and logs needed for security and troubleshooting.
- Communications: messages to support, reports you submit, and copyright or other claims, including the claimant's contact details.
- Referral information: if you join through a referral link or share your own, the referral code, which account referred which, daily link-visit counts, referral status and reward, and a one-way hash of the payment card fingerprint used to detect self-referrals.
- Cookies and similar technologies, as described in our Cookie Policy.
Section 03
3. How we use information
We use personal information only for the purposes below. For users in the EU, the EEA and the UK, each purpose is followed by its legal basis under data protection law.
- To provide the Studio: running your account, generating, storing and organizing your content, and publishing what you choose to publish. Legal basis: performance of our contract with you.
- To take payments and keep records: processing subscriptions and top-ups, preventing payment fraud and keeping tax and accounting records. Legal basis: performance of the contract and our legal obligations.
- To keep the Service safe: screening requests and uploads, preventing abuse, enforcing our policies and limiting misuse such as spam or deliberately failed generations. Legal basis: our legitimate interest in a lawful, safe and reliable service.
- To handle complaints: copyright notices, reports and the records the law expects. Legal basis: our legal obligations and legitimate interests.
- To communicate with you: receipts, payment problems, low-credit notices, cancellation confirmations and important changes. Legal basis: performance of the contract.
- To send optional product news: with your consent where required, or for existing customers where the law allows; you can opt out at any time. Legal basis: consent or legitimate interests.
- To run the referral program: applying the friend discount, adding reward credits and detecting referral fraud. Legal basis: performance of the program terms and our legitimate interest in preventing abuse.
- To measure and improve the website with analytics: only if you consent, which you can withdraw at any time. Legal basis: consent.
- To create a custom singer voice from voice recordings, and to animate photos of people: your explicit consent and, where the voice or face isn't yours, the authorization you confirm. Legal basis: consent.
Section 04
4. How your content is processed
When you submit a request, our servers send the inputs it needs, such as your prompt, lyrics, style text and any reference media, to our AI generation provider, Kie.ai, which runs the models and returns the results. We copy completed files to our own storage straight away. According to its documentation, the provider keeps generated files for about two weeks and request logs for about two months, and it may use its own sub-processors to run the models.
Before a request is sent, we check it automatically on our own servers to enforce our Acceptable Use Policy: text is screened for real artist names and prohibited content, uploaded images and video frames are scanned for adult content and for whether they show a person, and uploaded audio is compared with audio fingerprints of recordings removed for copyright. These checks use open-source models that run on our own infrastructure, so no third party receives your content for them. A refused request is not charged, and you can ask a person to review any automated decision by contacting us.
We do not sell your content, and we do not use your prompts, lyrics, uploads or generated tracks to train AI models. The free demos on our website work differently: what you enter there goes directly to a third-party Hugging Face Space under its own terms and Hugging Face's, not through our servers.
Section 06
6. International transfers
We are based in the United States, and our providers may process information in the United States, the European Union and other countries. When we transfer personal information from the EU, the EEA or the UK, we rely on adequacy decisions (such as the EU-US Data Privacy Framework for certified companies), standard contractual clauses or other approved safeguards. You can ask us for details of the safeguards that apply to a provider.
Section 07
7. How long we keep information
We keep personal information only as long as we need it for the purposes above, then delete or anonymize it.
- Account information: while your account exists. When you ask us to delete your account, a seven-day cooling-off period starts; after it, we delete your account and your private files. If you have an active subscription, deletion waits until it has ended.
- Your content: until you delete it. Deleted items stay in Trash for 30 days, unless you empty it sooner, and are then removed permanently.
- Billing and credit records: as long as tax, accounting and anti-fraud laws require, even after your account is deleted.
- Rights, consent, voice and likeness records: as long as the related content or voice exists, and afterwards as long as needed to handle disputes or legal claims.
- Moderation, copyright and report records: as long as needed to handle the case, apply our repeat-infringer policy and defend legal claims. Audio fingerprints of recordings removed for copyright are kept to stop them being uploaded again.
- Security logs: for the limited period needed to detect and investigate abuse.
- Backups: deleted data can remain in encrypted backups for up to about six months, until those backups are replaced.
- Data held by our AI provider: generated files for about two weeks and request logs for about two months, according to its documentation.
Section 08
8. Your choices and rights
Wherever you live, you can access, correct, export and delete your information, and opt out of marketing emails, using the tools below or by contacting us.
- Export: in Settings > Privacy, Export data prepares a copy of your account records and a list of your files, which you can download from your library.
- Delete: in Settings > Privacy, Delete account starts the deletion process, which you can cancel during the seven-day cooling-off period. If you have an active subscription, cancel it first: deletion waits until it has ended.
- Email: write to [email protected] from the address on your account. We may ask you to confirm your identity before acting.
- Timing: we respond within 30 days, or sooner where your local law requires, and tell you if we need longer.
Section 09
9. Notice for US residents
Residents of California and other US states with consumer privacy laws have the right to know what personal information we collect and how we use and disclose it, to access, correct and delete it, to receive a portable copy, and to opt out of its sale, its sharing for targeted advertising and certain profiling. We do not sell personal information, do not share it for targeted advertising, do not use it for profiling that has legal or similarly significant effects, and do not use sensitive personal information to infer characteristics about you. We have not done so in the past 12 months.
In the past 12 months we collected these categories, for the purposes in section 3, from you, your device and our service providers, and disclosed them to the service providers in section 5 for business purposes: identifiers (such as email address and IP address); customer records and commercial information (plan, purchases, credit transactions); internet activity (usage of the Service); approximate geolocation derived from IP address; audio and visual information (your content, voice recordings and photos you upload); and sensitive personal information limited to account sign-in credentials and, if you provide them, voice recordings used for a custom voice, which we use only to provide the features you request.
We treat browser signals such as Global Privacy Control as a request to opt out of optional analytics. We will not discriminate against you for using your rights. You can use an authorized agent with your written permission, and we may ask you to verify your identity. If we decline your request, you can appeal by replying to our decision; if we deny the appeal, you can contact your state attorney general. California residents can also ask, once a year, for information about disclosures for direct marketing purposes; we make none.
Section 10
10. Rights of users in the EU, EEA and UK
You also have the right to restrict or object to processing based on legitimate interests, to withdraw consent at any time without affecting earlier processing, and not to be subject to decisions based solely on automated processing that significantly affect you; you can always ask a person to review an automated moderation decision. You can complain to the data protection authority where you live or work, or in the UK to the Information Commissioner's Office.
Section 11
11. Voice recordings and photos of people
Voice recordings and photos of people can be sensitive. We process them only to create the voice or video you asked for, never to identify anyone, and we do not use face or voice recognition. You can revoke a saved voice at any time: we then stop using it and remove it from your account. Its recordings are deleted when you delete them or your account. Our AI provider does not currently offer a way to delete a voice created on its side; it handles that data under its own retention rules, and we will not use the voice again. Photos you upload stay in your private storage, visible only to you, until you delete them or your account.
Section 12
12. Children
The Service is intended for adults aged 18 and over. We do not knowingly collect personal information from children under 13, or from anyone under 18. If you believe a child has given us personal information, contact us and we will delete it.
Section 13
13. Security
We protect information with encryption in transit, least-privilege access controls, private storage for your files with short-lived download links, audit logs for administrative actions and regular backups. No system is perfectly secure; if a breach affects your personal information, we will notify you and the authorities as the law requires.
Section 14
14. Changes to this policy
We update this policy when our practices or providers change, and the date on this page shows the latest version. For material changes, we will tell you in advance by email or in the Service.
